1. Scope

These Terms and Conditions apply to all contracts between Jana Wohlgemuth, independent artist based in Hamburg, Germany (“Seller”), and private customers (“Customer”).

The Seller offers original artworks, commissioned works, and selected artworks for temporary rental. Any differing terms of the Customer shall not apply unless expressly agreed in writing.

2. Conclusion of Contract

The presentation of artworks does not constitute a legally binding offer.

A purchase contract is concluded only once the corresponding payment has been received by the Seller.

For commissioned works, the contract is concluded only after at least 50% of the agreed total price has been received as a deposit.

3. Prices & Small Business Regulation

All prices are final prices.

In accordance with §19 (1) German VAT Act, no VAT is charged or shown.

Additional costs such as shipping are stated separately prior to contract conclusion.

4. Payment Terms

Payment is currently accepted exclusively via bank transfer.

The contract becomes effective only after payment is received.

Commissioned works:
A 50% deposit is required before work begins. The remaining 50% is due upon completion of the artwork and before shipment or delivery.

5. Shipping & Delivery

Worldwide shipping to private customers is available.

Any customs duties, taxes, or import fees are the responsibility of the Customer.

Delivery times are non-binding and may vary for handmade or commissioned works.

Risk passes to the Customer upon delivery.

6. Retention of Title

The artwork remains the property of the Seller until full payment has been made.

7. Right of Withdrawal

Customers have a statutory right of withdrawal.

No right of withdrawal applies to:

• commissioned artworks

• personalized artworks

Original (non-commissioned) artworks may be returned within 14 days of receipt.

Return shipping costs are borne by the Customer.

8. Warranty & Liability

Statutory warranty rights apply.

Minor color deviations due to screen display do not constitute a defect.

Liability is limited to intent and gross negligence.

9. Copyright & Usage Rights

All artworks remain protected by copyright.

The purchase transfers ownership of the physical artwork only. All reproduction and usage rights remain with the Seller.

The Seller may use images of the artworks for self-promotion.

10. Commissioned Works

Details such as size, colors, style, and price are agreed individually.

Subsequent changes may incur additional costs.

Cancellation after work has begun is excluded.

11. Art Rental

Selected artworks may be rented upon request.

All rental terms are agreed individually in writing.

Ownership remains with the Seller at all times.

12. Data Protection

Please refer to the separate Privacy Policy on this website.

13. Governing Law & Jurisdiction

German law applies.
Place of jurisdiction is Hamburg, where legally permissible.

14. Severability Clause

If any provision is invalid, the remaining provisions remain effective.
